1. Introduction

Welcome to Skytext. These Terms of Service ("Terms") govern your use of the Skytext flight tracking SMS notification service ("Service") operated by Skytext ("we", "our", or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

2. Service Description

Skytext provides real-time flight tracking notifications via SMS. When you purchase our Service, we monitor the specified flight using third-party flight data providers and send text message updates to the mobile phone numbers you designate. Updates include information about flight status, position, and estimated arrival times.

3. Eligibility

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. Your Obligations

When using our Service, you agree to:

• Provide accurate and complete information, including valid flight details and phone numbers
• Only provide phone numbers of individuals who have consented to receive SMS notifications from us
• Not use our Service for any unlawful purpose or in violation of these Terms
• Not attempt to interfere with, compromise, or disrupt our Service or servers
• Not resell, redistribute, or commercially exploit our Service without our written consent

You are responsible for ensuring that any recipients you add have consented to receive SMS messages. We are not liable for any complaints or issues arising from messages sent to recipients you have designated.

5. Payment and Pricing

Our Service is offered on a per-flight basis. The price for tracking a flight is displayed at checkout and includes all SMS messages sent for that flight. All prices are in British Pounds (GBP) unless otherwise stated.

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. All sales are final once the flight tracking has commenced. Refunds may be provided at our discretion if the Service fails to function as described due to a fault on our part.

6. Refund Policy

We offer refunds in the following circumstances:

• If no SMS messages are delivered due to a technical failure on our part
• If the flight is cancelled before departure and no tracking messages have been sent
• If you contact us before the flight departs to cancel your order

Refunds are not available once tracking has begun and messages have been successfully delivered. To request a refund, please contact us at support@skytext.co.

7. Service Availability and Accuracy

We strive to provide accurate and timely flight information. However, our Service depends on third-party data providers, and we cannot guarantee the accuracy, completeness, or timeliness of flight data. Flight information may be delayed, incorrect, or unavailable due to factors beyond our control.

Our Service may be temporarily unavailable due to maintenance, updates, or technical issues. We do not guarantee uninterrupted access to our Service.

8. Intellectual Property

All content, features, and functionality of our Service, including but not limited to text, graphics, logos, and software, are owned by Skytext or our licensors and are protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from our Service without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Skytext shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of our Service.

Our total liability for any claims arising from or related to our Service shall not exceed the amount you paid for the specific flight tracking that gave rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10. Disclaimer of Warranties

Our Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Service will be error-free, uninterrupted, or free of viruses or other harmful components. You acknowledge that you use our Service at your own risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless Skytext, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of our Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our Service after such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or our Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
